PERSONAL INJURY CLAIMS

Satchell Moran are specialists in personal injury law with an established reputation for achieving optimum accident claim compensation for our clients.

It doesn’t matter what kind of injury you’ve experienced. Whether it was in a car accident, at work, or in a public facility, if the accident was due to the negligence of another then you are entitled to make a personal injury claim.

You might be unsure if your accident was bad enough to merit a case. But you should ask yourself if there will be long-term effects, even little ones, that could affect your life for years to come? Did it leave a pervasive psychological mark? And are there medical bills as a result of what happened?

SLIP OR TRIP ACCIDENTS

Slips, trips and falls are quite prevalent and are most common in public and workplaces. The worst of these kind of accidents can prove to be fatal but they can also lead to head injuries, back injuries, fractures and in the worst cases, paralysis.

Unlike road traffic accident claims, these can be somewhat difficult to make, especially as collecting evidence can be quite difficult. Moreover, in some cases, especially if the accident occurred on the street, it’s hard to determine who to make the claim against.

How & Where Do Most Slips, Trips, And Falls Occur?

Slips will occur mostly in places where the surface is still wet or is a slippery surface. In workplaces, this may be due to negligence, especially if it’s a wet floor that was not properly cleaned and dried. Appropriate signs are provided to indicate wet surfaces and as such, a company may be liable for any accidents that occur as a result of not applying the required safety procedures.

Making a slip or trip claim may be hard to pursue, because the council might not be held directly responsible for the accident. On the other hand, if the same was to happen in a parking bay of say a shopping centre, a hospital or a school, slips, trips and falls claims can be made against the said premises.

Tripping and falling accidents may seem like a regular occurrence but they are just as avoidable. Tripping on work equipment or wires that are left lying around is a common occurrence. The resulting fall may cause disastrous injuries that may leave you unable to work for a long period of time. These are some of the situations that can lead to claims being made.

How To Go About A Slip, Trip Or Fall Claim

Whether your slip, trip or fall accident occurs at work or in a public place, it is important to make note of any useful information. As for mentioned, these claims are difficult to prove and as such, compensation may be difficult to claim. Nonetheless, with the right solicitor and information on what to look out for, chances are high that your claim can get you compensated. If the slip, trip or fall was caused by factors beyond your control, you stand a chance of being compensated for the injuries suffered and any associated losses.

You can determine who is liable for a claim based on where the accident occurred. If you slip on a pavement that is cracked or uneven, the council could be liable. If your mishap occurs in a hotel, at the dentist or a supermarket, the owner of the premises is liable. If you manage to have eyewitnesses, make sure you take down their personal details. Whatever information you can obtain will be helpful but remember your well-being is of

We will assess your case quickly, understanding both the evidence the insurance company will need to agree to pay your claim and the different ways which your injuries may be affecting you. So, you know where you stand from the outset.

INJURY AT WORK

Making A Claim for Injury Resulting from An Accident at Work

Whatever health and safety procedures an employer has put in place, work accidents do still happen.  Accidents can result in injuries that range from minor cuts and sprains to broken bones, amputations, burns and, regrettably, fatalities.

In the U.K., employers and business owners are legally responsible for the welfare and safety of their staff and any visitors to their premises.  All businesses must have adequate insurance and must adhere to Health & Safety regulations.

If your employer has failed to meet these responsibilities and this has resulted in you sustaining an injury at work, you may be entitled to compensation.

Even if your own actions have contributed to the accident, you may still be able to claim injury compensation for an accident at work if your employer is believed to have been mainly responsible for your injury.

Accident Types

  • Slips, trips or falls
  • Dangerous practice or procedure in the workplace
  • Defective or poorly maintained machinery or equipment
  • Failure to protect from toxic substances
  • Being hit by a falling object
  • Non-adherence to Health & Safety Regulations
  • Negligent actions of fellow employees
  • Insufficient or lack of proper training
  • Being assaulted at work
  • Accident while operating a heavy equipment such as a fork lift, digger or crane
  • Faulty lifting/manual handling practices as a result of lack of training

Claim Time Limit

There is a standard three-year time limit within which you can start legal proceedings.

The three-year deadline begins on the date that the accident occurred, or from the date on which you realised that your injury resulted from the accident.

In the case of a fatality, the three-year limitation commences from the date of death.  If the injured party dies during the course of their case, the three-year deadline begins from the date of their death.  This is to allow their family time to continue with the claim.

We will assess your case quickly, understanding both the evidence the insurance company will need to agree to pay your claim and the different ways which your injuries may be affecting you. So, you know where you stand from the outset.

CRIMINAL INJURIES

If you have been subject to an attack or an assault, then you’ll know just how distressing it can be. The damage caused is not just physical; often the psychological harm is far longer lasting.

Our criminal injury lawyers are dedicated to fighting to ensure you receive the compensation you deserve, as well as helping you to find the support you need to recover from such a distressing experience.

Our Criminal Injury Claims Process

If you have been injured in a violent crime, you could be entitled to compensation from the Criminal Injuries Compensation Authority (CICA). This is a government body created to provide compensation to those who have suffered injuries as a result of an attack.

We have helped clients to claim compensation for a wide range of incidents, including assaults and sexual abuse.

Our team of expert solicitors will work with you and the CICA to ensure you receive the best possible compensation settlement. We can also advise you on state benefits and other payments, which may be available if your injuries have left you unable to work or needing ongoing care and support.

If your injuries are so severe you are left needing extensive rehabilitation or specialist medical treatment, we can offer advice about seeking medical treatment and rehabilitation organisations.
