Guide: How To Claim Against The Police

Introduction

While we at Satchell Moran Solicitors have deep respect for the dedication of most police officers who serve to protect the British public, we also recognise that accountability is essential. If you have experienced unfair or unlawful treatment by the police, you are entitled to seek justice.

There are two main routes available to you if you wish to address police misconduct.

The first option is to make a formal complaint directly to the police force involved or to the Independent Office for Police Conduct (IOPC). In more serious cases, the IOPC may decide to investigate your complaint.

However, our experience shows that this process can be lengthy and, at times, ineffective, often failing to resolve the underlying issues or bring about meaningful change.

The second, and often more effective, option is to seek legal advice and pursue a civil claim against the police.

Civil claims provide a real opportunity for accountability, and successful cases can result in an apology, financial compensation, and most importantly, recognition of your experience by the authorities.

Common Types of Claims Against Police

Police misconduct can take many forms, so it’s important to identify the nature of your experience.

You may be eligible to claim if you have suffered from:

  • Unlawful or wrongful arrest
  • Unlawful or wrongful detention
  • Unlawful stop and search
  • Injury caused by excessive force
  • Police trespass
  • Injuries from taser, pepper spray or police dogs
  • Negligence-related injury while in custody
  • Accidents involving police vehicles
  • Arrested/Detained for failing to attend court, having had no knowledge of the court hearing
  • Breach of your data protection rights

How To Initiate A Claim Against The Police

To begin, we recommend contacting a solicitor who specialises in actions against the police.

These cases can be complex and are frequently challenged, so expert legal support is essential for the best chance of success.

Next, gather all available evidence related to your incident.

This might include video footage, photographs, medical reports (if injuries were sustained), details of the arrest date and location, and the names or badge numbers of the officers involved. Your solicitor will use this information to build a strong case and determine whether your rights have been violated.

Your solicitor will then draft and send a letter of claim to the relevant police force, outlining your allegations and what you are seeking.

From this point, your solicitor should keep you informed about the progress of your case, typically providing updates every one to three weeks.

Negotiations will then take place between your legal representative and the police. Most cases are resolved through out-of-court settlements, with only a small number proceeding to trial.

Regardless of the outcome, your solicitor will represent you throughout the process.

Time Limits For Making A Claim

It’s important to be aware of the time limits for making a claim.

Generally, you have six years from the date of the incident to start proceedings.

To avoid missing this deadline, we advise beginning the process as soon as possible.

If your claim relates to an injury, you have three years from the date of the injury to make your claim.

No Win, No Fee – No Risk To You

All our claims are handled on a no win, no fee basis, which means there is no financial risk for you.

If your case is unsuccessful, you will not be charged.
