Types of Death in custody claims

Claims involving death during or following restraint, the use of batons, incapacitant sprays, or firearms.

These claims focus on a failure of duty of care. This could  be due to inadequate medical treatment, a failure to identify suicide risks (self-inflicted deaths), or unsafe staffing levels.

This type of Death in Custody Claim can happen when a person dies after police contact but was not under formal arrest at the time, such as during a pursuit or a welfare check.

These claims arise when a  death occurs shortly after a peron has been released and where the custody period is considered a contributing factor.

These claims can arise where a person is released while suffering from an undiagnosed or untreated illness that causes their death.

Claims brought under Article 2 of the European Convention on Human Rights allege that the state failed in its positive obligation to protect a life, or that the death was caused by unlawful state action. This can mean that the State failed in its obligation not to take life intentionally or through excessive force or it failed in its obligation to take proactive measures to protect a person whose life is known to be at risk such a prisoner who is suicidal.

A death in custody is not restricted to a death that occurs solely when a person dies in the custody of the police. It covers deaths in police stations, prison cells, immigration detention, or during arrest, including fatal shootings, restraint-related deaths, a failure to identify suicide risks, deaths that occur during a pursuit or welfare check and medical incidents. 

Time frames for claims against the Police, please note you have a 6 month limitation period to bring any claim under the equality act, 1-year limitation period to bring a claim for any breach of human rights, a 3-year limitation period to bring any claim for injury and a 6-year limitation period for any unlawful arrest/detainment/false imprisonment or trespass to your property.

In England and Wales, the Independent Office for Police Conduct (IOPC) normally investigates police-related deaths, while the Prisons and Probation Ombudsman (PPO) investigates prison deaths.

Family members and/or dependants of the deceased may be able to bring a claim. 

We offer a no-win, no-fee agreement. This means you don’t pay a penny upfront. If we win, we take a success fee (typically 25%) from your compensation. Legal Aid is also available for eligible clients.
